    All types of private buildings including domestic / composite / commercial / industrial buildings, etc. (Domestic buildings not exceeding 3 storeys are excluded)

    Once every 5 years.

    5. How are target buildings selected?
  •  
    A Selection Panel comprising representatives from professional institutions, relevant non-government organisations, property management professionals, District Councils and relevant Government departments has been established to render advice to the Buildings Department (BD) for the selection of target buildings.

    6. What are the criteria adopted by the Selection Panel for selecting target buildings?
  •  
    The criteria include allocation of eligible buildings in the 18 districts on a pro rata basis and consideration of relevant factors including the maintenance condition of the buildings and windows, repair records of the windows, the traffic and pedestrian flows adjoining the buildings, location and building clusters, etc. and the buildings nominated by the District Councils.

    7. Who are qualified to carry out the prescribed inspection under the MWIS?

    A Qualified Person (QP), i.e. a person whose name is on one of the following registers kept by the BD: Authorized Persons, Registered Structural Engineers, Registered Inspectors, Registered General Building Contractors or Registered Minor Works Contractors who are qualified to carry out relevant minor works in respect of windows.

    9. What types of contractors are qualified to carry out the prescribed repair under the MWIS?
  •  
    Registered contractors including registered general building contractors (RGBC) or registered minor works contractors (RMWC) who are qualified to carry out the relevant works in respect of windows. If the Qualified Person is a RGBC or RMWC, he may also carry out the prescribed inspection and prescribed repair for the windows.

    10. Are all registered minor works contractors qualified to carry out prescribed inspection and prescribed repair of windows?
  •  
    No, it depends on the scale and location of the windows. The registered minor works contractors should be registered for carrying out the relevant class, type and item of minor works in respect of windows.

    11. What is the scope of the prescribed inspection under the MWIS?
  •  
    All the windows in the common parts of a building and within individual premises of the building.

    12. How will the owners know that their building has been selected by the BD for the MWIS?
  •  
    The BD will issue pre-notification letters to the building owners / Owners’ Corporation or post the letter at a conspicuous part of the building.

    13. When will the BD issue statutory notices after the issue of pre-notification letters?
  •  
    Not less than 2 months.

    14. Will the owners of the selected buildings receive statutory notices for the MWIS?
  •  
    Yes, the Buildings Department will issue statutory notices to individual owners for carrying out the prescribed inspection for windows within their premises.

    15. When should the owners of individual premises complete the prescribed inspection and prescribed repair after receiving the statutory notice?
  •  
    Usually within 6 months.
  •  
    16. For windows in common parts of a building, how much more time will the BD allow for owners to organise the prescribed inspection and prescribed repair?

    Not less than 3 months extension.

  •  
    The Hong Kong Housing Society (HKHS) and the Urban Renewal Authority (URA) have launched the Integrated Building Maintenance Assistance Scheme which provides one stop financial assistance and technical support to building owners / Owners' Corporation.     19. Is an inspection report required to be submitted upon completion of the prescribed inspection and prescribed repair?

    The Qualified Person is only required to submit a completion certificate in the specified form to the BD.

    20. Are there any legal liabilities of owners / Owners’ Corporation for not complying with a statutory notice for MWIS?
  •  
    The owners / Owners’ Corporation who do / does not comply with a statutory notice for mandatory window inspection without any reasonable excuse may be served with a penalty notice for a fixed fine of HK$1,500. Repeated offenders may be prosecuted and are liable on conviction to a fine of HK$25,000 and imprisonment for 3 months.
