Signboard . Erection of Signboards

Erection of signboards

Erection of signboards is "building works" subject to the control of the Buildings Ordinance (BO) where the works are not minor works or designated exempted works, the erection of a signboard require prior approval and consent from the Building Department (BD). To facilitate the erection of signboards legally to comply with the required safety and health standards, the BD operates a fast-track processing service for such applications. Under this system, the plans and documents submitted by the Authorized Person and Registered Structural Engineer in accordance with the relevant Practice Note will be processed within 30 days of the date of receipt of the submission.

“Minor Works”

The erection of certain signboards that have been designated as minor works may be carried out lawfully and safely, through the simplified requirements of the "Minor Works Control System" .

The size, location and respective criteria of each item of minor works are set out in the Building (Minor Works) Regulation [B(MW)R]. These minor works are classified into three classes – Class I, Class II & Class III according to their scale, complexity and risk to safety.

Designated Exempted Works

The following "Designated Exempted Works" which are related to signboards may be commenced without prior approval of plans and consent for commencement of works from the BD and without the need to appoint building professionals and registered contractors:

Reminders:

If the signboard is to be erected at the exterior or other common parts of the building, the signboard owner should liaise with the co-owners of the building/owners' corporation, the management company and/or the owners concerned regarding the right of use of these common parts before the commencement of the works, and to observe all obligations as stipulated in the deed of mutual covenant of the building. The obligations include but are not limited to the arrangement of third-party liability insurance. Without obtaining the consent of the co-owners of the building/owners' corporation, the management company and/or the owners concerned for erection of any signboard at the exterior or other common parts of the building, the signboard owner may be in breach of the deed of mutual covenant of the building and liable to civil proceedings and bearing of civil liabilities.
