Fire Safety . Objective and Scope

Fire Safety (Commercial Premises) Ordinance (Cap.502) [FS(CP)O]

specified commercial buildings

Purpose

The purpose is to provide better protection from the risk of fire for occupants, users of, and visitors to prescribed commercial premises and specified commercial buildings subject to this Ordinance.

Scope of the Ordinance

Applies to the following prescribed commercial premises and specified commercial buildings

(a) A building or part of a building is a "Prescribed Commercial Premises (PCP)" if it is used, or is proposed to be used, for carrying on

  • any of the following 5 commercial activities and
  • the total floor area of the building or part exceeds 230m2

(b) "Specified Commercial Building (SCB)" is a building

  • that is being used for the purposes of office, business, trade or any entertainment, and
  • was constructed on or before 1.3.1987 or the plans of the building works of which were first submitted for approval on or before 1.3.1987.

Fire Safety (Buildings) Ordinance (Cap.572) [FS(B)O]

Purpose

  • The purpose is to provide better protection from the risk of fire for occupants, users of and visitors to composite buildings and domestic buildings subject to this Ordinance.

Scope of the Ordinance

Applies to the following composite building or domestic building

A."Composite building"

  • a building constructed or intended to be used, partly for domestic purposes and partly for non-domestic purposes; or
  • was constructed on or before 1.3.1987 or the plans of the building works of which were first submitted for approval on or before 1.3.1987.

B."Domestic building"

  • for domestic purposes with more than 3 storeys ; and
  • was constructed on or before 1.3.1987 or the plans of the building works of which were first submitted for approval on or before 1.3.1987.
This Ordinance also applies to the home ownership scheme buildings, tenants purchase scheme buildings and public housing but does not apply to such a building if it was constructed in accordance with the Buildings Ordinance (Application to the New Territories) Ordinance (Cap. 121) commonly known as New-Territories Exempted House.
