Penalties

It is the owner's responsibility to comply with orders issued by the Buildings Department. Any person who fails, without reasonable excuse, to comply with an order shall be guilty of an offence.

The Buildings Department will issue statutory orders/notices/fire safety directions to the relevant persons in accordance with the prevailing enforcement policy/control systems/mandatory schemes.

"The person who arrange for the works to be commenced or carried out" has knowingly failed to appoint the required "Prescribed Building Professional" and/or "Prescribed Registered Contractor", he will be liable on conviction to a maximum penalty of a fine at level 6 (HK$100,000 at present).

The BD may also arrange for the required inspection, investigation and remedial works to be carried out by its consultant and contractor, and then recover the cost of the inspection, investigation and remedial works as well as the supervision charge from the owners/OC, together with a surcharge of not exceeding 20% of the aforesaid cost and supervision charge above.
